If you have used 6 years without PERM/I140 then you are no longer a Cap Exempt with 1year or any number of years of Out of USA… You have to go through CAP/lottery again.

If you have used 6 years but have a approved i140 then you don’t need to be out for 1 year.

If you have not used 6 years, with or without i140, then you continue to be cap exempt without need of a reset of 1 year…

So, that person gave contradictory answer… “reset of clock with 1year” vs “cap exempt”

so i asked :slight_smile:

@srhere I wish you were true but as ntn pointed out: cap exempt or not, you need to be out for 1 year.
